1. Acceptance of Terms

By accessing or using Curiosa, you agree to be bound by these Terms of Service. If you do not agree with any part of these terms, you may not use our service.

2. Service Description

Curiosa provides:

• AI-powered identification and appraisal of oddities, antiques, and collectibles
• A digital cabinet to archive and organize your collection
• Price range estimates and rarity scoring
• Historical context and provenance information
• Public and private sharing options for your cabinet

4. Subscription & Pricing

Curiosa Cabinet offers the following tiers:

• Free tier: 5 free scans to try, unlimited saved items in your cabinet
• Scan Pack: One-time purchase of 25 bonus scans (€9.99) that never expire
• Premium: 100 scans per month, unlimited cabinet storage, priority processing, and advanced features

Premium subscriptions are billed monthly or yearly. Prices are displayed at checkout and may be updated with reasonable notice to existing subscribers. All payments are processed securely through Stripe.

Cancellation takes effect at the end of your current billing period. No partial refunds are provided for unused time.

5. User Accounts & Content

• You must be 18 years or older, or have parental consent, to use this service
• You are responsible for maintaining the security of your account credentials
• You retain ownership of photos you upload
• By uploading content, you grant Curiosa a license to process, display, and store your content as necessary to provide the service
• You may delete your content at any time through your cabinet

6. Prohibited Content & Use

You may not upload or use the service for:

• Illegal wildlife products (ivory, endangered species items, etc.)
• Nazi memorabilia or hate-related artifacts
• Stolen or illegally obtained items
• Fraudulent use of appraisals (misrepresenting estimates as certified valuations)
• Automated scraping, API abuse, or attempts to reverse-engineer our systems
• Harassment, spam, or abusive behavior toward other users
• Content that violates any applicable laws or regulations

We reserve the right to remove content and terminate accounts that violate these terms.

7. Content Moderation

To maintain a safe and legal platform:

• Our AI automatically flags potentially prohibited content for human review
• Flagged items may be temporarily hidden until reviewed by our moderation team
• We aim to complete moderation reviews within 48 hours
• You may appeal moderation decisions through the provided appeal process
• Repeated violations may result in account suspension or termination

8. Account Termination

We may suspend or terminate your account if you:

• Violate these Terms of Service
• Upload prohibited content repeatedly
• Engage in fraudulent or abusive behavior
• Attempt to circumvent our security measures

Upon termination, your access will be revoked and your data will be deleted according to our Privacy Policy. You may request your data before termination takes effect.

9. Intellectual Property

Curiosa owns all rights to the service, its design, branding, and AI technology. You may not reproduce, redistribute, or commercially exploit AI-generated content, analysis, or any part of our service without written permission.

10. Limitation of Liability

• The service is provided "as is" without warranties of any kind
• We do not guarantee the accuracy of any appraisal, identification, or historical information
• We are not liable for financial decisions made based on our estimates
• Our maximum liability is limited to the subscription fees you have paid in the preceding 12 months

11. Dispute Resolution

In the event of a dispute:

• We encourage you to contact us first to attempt informal resolution
• Most disputes can be resolved through our support team within 14 days
• If informal resolution fails, disputes will be resolved through binding arbitration or the courts of Rotterdam, The Netherlands
• EU consumers retain the right to bring claims in their local courts

12. Modifications to Terms

We reserve the right to update these terms at any time. Significant changes will be communicated via email at least 14 days before they take effect. Continued use of the service after changes constitutes acceptance of the updated terms.
